Welcome to Guess the Note ("we", "us", or "our").

These Terms of Use ("Terms") govern your access to and use of the Guess the Note website and services available at:

Guess the Note is a free online music training platform that provides:

• Ear Training exercises to practise note recognition
• Pitch Matching exercises to practise singing accuracy
• Virtual piano tools and related learning features

By accessing or using Guess the Note, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the service.

You may use Guess the Note for personal, educational, and non-commercial purposes.

You agree not to:

• Use the service for unlawful purposes
• Attempt to disrupt, damage, or gain unauthorised access to the service
• Reverse engineer, reproduce, or modify any part of the service without permission
• Use automated systems to excessively access or scrape the service
• Misrepresent your identity or misuse any support channels

We may restrict or terminate access to the service where we reasonably believe it is being misused or these Terms are being violated.

Guess the Note does not require an account to use its core features. You may use the service as a guest.

Optional accounts are provided through Clerk. You may sign in with:

• Email (for example, a one-time sign-in code or magic link)
• Google

If you create or use an account, you are responsible for maintaining the security of your account and the email address or sign-in method associated with it. You should notify us if you believe your account has been accessed without your permission.

Guest progress and preferences may be stored locally in your browser. If you sign in, we may back up certain progress data to our servers so you can restore it across devices. Device preferences such as theme, language, and calibration settings may remain stored only on your device.

We may suspend or terminate accounts that we reasonably believe are being misused, or that violate these Terms.

Guess the Note is designed as a learning and practice tool.

While we aim to provide accurate results, we do not guarantee that:

• Pitch detection will always be accurate
• Use of the service will produce any particular improvement in musical ability
• The service or its results will replace professional music instruction

Your progress may depend on factors such as practice consistency, the exercises you use, and individual circumstances.

The Pitch Matching feature may request access to your microphone.

Microphone audio is analysed locally in your browser to provide real-time pitch feedback.

We do not:

• Record your voice
• Store audio recordings
• Upload audio data to our servers

You may disable microphone access at any time through your browser settings.

The Guess the Note service, including its original content, design, software, graphics, and other materials, is owned by or licensed to us, except where otherwise indicated.

You may use the service for personal learning purposes, but you may not copy, reproduce, distribute, sell, or create derivative works from our service without prior permission, except where permitted by applicable law.

Guess the Note relies on third-party services to provide certain functionality, including hosting, authentication, database hosting, analytics, email, video hosting, and optional support or payment services.

Third-party services may be subject to their own terms and privacy policies. Your use of those services may also be governed by their respective terms. We are not responsible for services operated by third parties.

We aim to keep Guess the Note available and reliable, but we do not guarantee that:

• The service will always be available
• The service will be error-free
• Features will always remain unchanged

We may update, modify, suspend, or discontinue parts of the service at any time. We may also perform maintenance or experience interruptions caused by circumstances outside our control.

Guess the Note may provide optional support or donation features through third-party platforms such as Buy Me a Coffee.

Any payments or donations are processed by the relevant third-party provider and are subject to that provider's terms and policies. Guess the Note does not store your payment information.

To the maximum extent permitted by law, Guess the Note and its creators exclude liability for loss or damage arising from or relating to your use of the service, including loss of browser-stored or cloud-backed progress, settings, service interruptions, errors, or reliance on exercise results or feedback.

Nothing in these Terms excludes, restricts, or modifies any rights or guarantees that cannot lawfully be excluded, restricted, or modified under applicable law, including rights you may have under the Australian Consumer Law.

We may update these Terms from time to time.

The updated version will be posted on this page with a revised date. Where appropriate, we may provide additional notice of material changes. Your continued use of Guess the Note after the updated Terms take effect constitutes acceptance of the updated Terms, to the extent permitted by law.

These Terms are governed by the laws of Victoria, Australia, to the extent permitted by applicable law.

Any disputes relating to these Terms or the service will be subject to the applicable courts and laws of Victoria, Australia, to the extent permitted by law.
